GT&Cs Shop Online Shop – General Terms & Conditions

General Terms & Conditions (GT&Cs) for the Swiss Alpine Club SAC Online Shop

Area of Application

The General Terms & Conditions (GT&Cs) apply to the Online Shop of the Swiss Alpine Club SAC and the terms of use of the digital content provided by the SAC Route Portal. The vendor of the goods and services therein is the Swiss Alpine Club SAC, headquartered in Bern, Switzerland. The Swiss Alpine Club SAC reserves the right to amend these GT&Cs at any time and without notice. Provisions or general terms and conditions of the customer or of third parties which conflict with these GT&Cs are invalid. The GT&Cs also apply exclusively if the Swiss Alpine Club SAC provides its services without restriction after becoming aware of deviating provisions or terms and conditions.

1. Orders and Payment

Orders

  1. All orders, including those transmitted by telephone or electronically (i.e. without an original signature), are binding for the customer. The customer will be informed in the event of delivery issues.
  2. By clicking on the "Commit to buy" button, the customer submits a binding request to conclude a contract.  
  3. The customer will receive an email confirming receipt of the order. This confirmation does not constitute acceptance of the order but only informs the customer that their order has been received.   
  4. A purchase contract for physical products does not come into effect until the Swiss Alpine Club SAC accepts the customer's order by shipping the ordered item(s) to the customer.  
  5. Orders from outside Switzerland can only be placed by email or telephone, and not via the Online Shop. The purchase contract is binding as soon as the customer has paid for the goods in advance.

Prices

  1. All prices are in Swiss francs and include the statutory value added tax (VAT).
  2. Prices are subject to change without notice. The price to which the customer has agreed at the time of purchase applies. The contract cannot be contested on the grounds of erroneous information or typing errors.
  3. The discounted prices for SAC members are only valid if the customer has active membership at the time the contract is concluded. To receive the membership price, the SAC member must be registered and place the order while logged in.   
  4. Delivery delays are never grounds for price reductions.
  5. The statutory Swiss VAT is not charged for deliveries to addresses abroad. Country-specific import duties and taxes may apply to goods that are imported to countries outside Switzerland. These must be borne by the customer or will be charged to the customer.

Shipping costs

  1. Shipping costs to addresses in Switzerland and Liechtenstein are CHF 9.00 (Priority) and CHF 7.00 (Economy). Shipping is free of charge for orders over CHF 60.00.

Payment

  1. The Swiss Alpine Club SAC accepts the following payment methods for transactions in the Online Shop: Eurocard/Mastercard, VISA, Postcard and PayPal.
  2. The maximum value of goods which can be ordered on invoice is CHF 200.00. For orders exceeding this amount, we accept electronic means of payment only. Electronic devices cannot be ordered on invoice.
  3. Unless otherwise agreed, the amount is due 30 days after the invoice date, without any deductions or bank fees.  
  4. In the event of late payment, fixed reminder fees will be charged based on the level of reminder. In the event of payment arrears, the customer is obliged to reimburse all reminder and collection expenses incurred as a result of such payment arrears and which are necessary for legal action.  We expressly reserve the right to claim further damages caused by payment arrears.
  5. Delivery abroad is only available against advance payment.  
  6. The delivered goods remain the property of the Swiss Alpine Club SAC until the customer has paid the invoiced amount in full.

2. Delivery and Shipping

Delivery area

The Swiss Alpine Club SAC ships to Switzerland and abroad.  Some products cannot be shipped abroad (e.g. knives and electronic devices). Further information is available from the SAC shipping department (see below for contact details). 

Delivery of goods

  1. Unless otherwise stated, goods are sent by Swiss Post.
  2. The quoted delivery times are non-binding and subject to change by the Swiss Alpine Club SAC without notice, even after receipt of the customer's binding request.  Orders are usually processed within 1–2 working days. Delivery by A-Post (Priority) generally takes 2–3 working days. Delivery by B-Post (Economy) usually takes 5–6 working days. 
  3. In the event of a delivery delay of 14 working days or more since the non-binding delivery date, the order may be cancelled. If the delivery delay refers to part of the order, only this part is subject to the cancellation option.
  4. If the ordered goods are not yet available or temporarily unavailable, the customer will be informed, and the goods will be reserved for the customer. Reserved orders may be cancelled at any time. If only part of the ordered goods are unavailable, the cancellation option only applies to the non-deliverable items.

3. Withdrawal, Exchange and Warranty

Withdrawal

  1. The SAC grants the customer a voluntary right of withdrawal. The customer is entitled to withdraw from the purchase contract within 14 days of receipt of the goods.
  2. The withdrawal may be submitted in writing (e.g. letter, email, fax) or by returning the goods to the SAC shipping department. The timely submission of the withdrawal is deemed sufficient to comply with the withdrawal period.
  3. The right of withdrawal is excluded if the goods are not complete, not in their original packaging, or if the return shipment is incorrectly addressed.
  4. The customer bears the burden of proof, costs and risk for returning the goods.

Exchange

  1. An exchange is possible at any time in the event of wrong delivery or manufacturing faults. The customer must check the received goods for defects immediately after delivery. The faults must be reported to the SAC shipping department within 8 days of receipt by email, telephone, fax or post.
  2. If the customer has already paid for the goods, they are entitled to a full refund from the SAC. There are no shipping charges for replacement deliveries.  
  3. The SAC may refuse to accept the returned goods in the following circumstances:
    • The goods are not complete
    • The return delivery is not correctly addressed to the SAC shipping department
    • The original packaging is defective

In addition, the SAC may charge a handling fee for returned goods.

Warranty (or guarantee)

Unless otherwise stated, the statutory warranty period of two years applies to Clubshop products purchased in the Swiss Alpine Club SAC Online Shop (excluding published material such as books, maps or vouchers). Consumable items are excluded from these terms.  

The customer acknowledges that the manufacturer's warranty provisions generally only provide a right of rectification (repair) or replacement (replacement item), unless there are grounds for exemption. The customer is not entitled to compensation for damages or for any loss of sales incurred. The choice of method of rectification is at the discretion of the Swiss Alpine Club SAC.  

If the purchaser wishes to make a claim for a fault in the product (warranty claim), they must get in touch with the SAC shipping department in advance by telephone or email (see below for contact details). The latter will check whether there are any grounds for exemption (e.g. damage caused by the item falling, water damage, third-party damage or incorrect handling). Faulty products will not be collected unless otherwise stated. The customer must send the faulty product to the SAC shipping department at their own expense and risk. 

The customer is not entitled to a free replacement product for the duration of the repair or the time period until a replacement item is delivered. The faulty product or the replaced parts shall become the property of the respective vendor or manufacturer. Should it be determined that the product is not faulty and that the defects are not covered by the warranty, the customer bears the cost and risk of having the product returned to them. In addition, a handling fee may be charged.

4. Vouchers

In order to enable vouchers to be redeemed in SAC huts and for SAC courses, the SAC issues two different types of voucher:

  1. SAC Gift Vouchers issued by the SAC office: these are valid in all SAC huts and for SAC courses. Available from CHF 20.00 to 100.00. For amounts exceeding CHF 100.00, multiple vouchers must be purchased. Vouchers are sent by post. If the voucher is to be sent to a different recipient, the recipient's address must be provided. When visiting a hut or paying a course fee, the original voucher must be given to the hut warden or the SAC course administrator. The voucher amount will be deducted from the invoiced total.
  1. SAC Online Vouchers are only valid for purchases in the Online Shop (SAC merchandise, books, maps). Online Vouchers are generated electronically with an 8-digit code. After purchase, this is sent to the customer's email address. To redeem the voucher in the SAC Online Shop, the 8-digit code must be entered in the field provided on the payment page. If the payable amount is lower than the voucher value, the voucher value will be reduced by the amount paid and the voucher may be redeemed against a later order using the same code. If the payable amount is higher than the voucher value, the total amount will be debited, and the remaining amount can be paid by one of the available payment methods. Online Vouchers are not redeemable against services of the SAC sections, in SAC huts or for SAC courses.

5. Additional Terms of Use for Digital Content and Services

Definition

The Swiss Alpine Club SAC Route Portal and the SAC-CAS App include digital content and services. The subscription contains the digital content and services provided by the SAC, namely the SAC Route Portal and the SAC-CAS App. The subscription gives the user access to route descriptions for a selection of mountain sports disciplines, to safety information and other mountain sports-related services.

Ordering and payment

  1. The purchase contract for digital content and services (subscription) is deemed accepted when the content is made available on the customer's end device.
  2. Credit cards will be charged immediately after the order has been placed.  
  3. Digital content will be activated for the customer's end device after payment has cleared.

Subscription to the SAC Route Portal and SAC-CAS App

  1. The minimum subscription duration is 30 days. The service must be paid for in advance by credit card. Once payment has cleared, the SAC will grant access to the purchased content.
  2. The subscription is automatically renewed in accordance with the selected time period. The corresponding fee will be charged to the customer's credit card on the first day of the new subscription period.   
  3. The customer may cancel the service at any time, to take effect at the end of the subscription period. The service remains available until the end of the subscription period.
  4. There is no right of withdrawal, since the product cannot be returned.

Right of use

The customer is granted the contractually agreed right to use the online content (digital content and services), which is limited to the duration of the subscription. This right may not be transferred to third parties.

The accessed content and documents may be used by the customer solely for personal use. Any commercial use, in particular selling, renting, leasing or lending programmes or documents, both in printed and file form, is not permitted.  Likewise, permanently storing substantial data volumes for the production of own collections is not permitted.

Scope of service, periods of unavailability

The SAC is responsible for ensuring that its servers are connected to the internet and must ensure accessibility, e.g. through suitable contracts with its provider.

As a rule, the online services (digital content and services) of the SAC can be used 24 hours a day, 7 days a week. The SAC is not responsible for downtimes due to the lack of technical requirements to be provided by the customer for access to and use of the online service, due to disruptions in the data transmission network or defects for which the data transmission provider is responsible, or due to force majeure, in particular power cuts or disruptions in the telecommunications networks.

6. Liability

The SAC accepts no liability for damages resulting directly or indirectly from the operation, use and malfunction or operational failure of the products. Notably, any liability for ensuing damage such as loss of profit, claims for compensation by third parties or damage to recorded data is excluded (no product liability). The SAC sets high quality standards for the publication of print and digital media. Nevertheless, no liability can be assumed for the completeness and correctness of the contents of the website. This also applies to the content of external links. The operators of such links are solely responsible for the content therein.  

The Swiss Alpine Club SAC excludes liability to the extent permitted by law for all direct and indirect damages arising from the use of the Online Shop or in the context of ordering goods or concluding contracts through the Online Shop. Notably, the Swiss Alpine Club SAC excludes any liability for minor and moderate negligence. Nor does the Swiss Alpine Club SAC accept any contractual or non-contractual liability for damage caused by auxiliary persons summoned to provide a service.

7. Data Privacy

The use of personal data is governed by the current version of the Privacy Policy.

8. General Information

The Swiss Alpine Club SAC expressly reserves the right to amend, expand or remove parts of the website or the offer, or to discontinue the domain without prior notice. If individual provisions of these GT&Cs do not, do not fully or no longer comply with the applicable legal situation, the content and validity of the remaining parts of these GT&Cs shall remain unaffected.

9. Applicable Legislation

The provisions of Swiss legislation apply, including for orders that are placed from abroad or goods that are shipped abroad. The Vienna Sales Convention does not apply. The respective binding version can be viewed and printed out on our website.

10. Place of Performance and Jurisdiction

The place of performance and jurisdiction for any disputes is Bern.
